Not Guilty Verdict by Jury in OUI Trial

Brett Lovins won an acquittal for his client charged with operating a motor vehicle under the influence of alcohol (OUI/DUI) after a jury trial in the Malden District Court. Brett’s client’s car had been involved in a single-car accident without any injuries. During the prosecutor’s case in chief, Brett highlighted the failure of the police to investigate an eyewitness on the scene or to review 911 audio recordings pertaining to the accident. Brett called to the stand several defense witnesses, including another occupant in the car, who testified that it was he, and not Brett’s client, driving the car. The jury deliberated for less than a half-hour before returning the Not Guilty verdict in favor of Brett’s client.
